EGA Position Paper: The European Union Patent Court
The EGA welcomes the initiative of the European Commission to create a European and Community Patent Court, and in this position paper suggests some amendments to the proposed draft agreement. These amendments are aimed at improving the text as a whole and at contributing to create a more efficient and balanced system for the future. The key risks for the European generic medicines industry are the transitional period (opt-out system) and the split jurisdiction.
